More than 80 million people live in one of 15 states where same-sex couples can marry, but there are no statewide laws that prohibit employment or housing discrimination based on sexual orientation or gender identity, according to a report from the Human Rights Campaign.

The one thing theses 15 states have in common? Same-sex marriage was legalized there following a court decision and not because of a popular vote.

Three states — New Hampshire, New York and Wisconsin — prohibit employment and housing discrimination for based on sexual orientation only, and not gender identity, according to the report.

Statewide laws on same-sex marriage and non-discrimination

The HRC’s State Equality Index, released Friday, categorizes states based on legislation related to LGBT issues and found a number of states that were the first to legalize marriage for same-sex couples are lacking protections for gay, lesbian, bisexual or transgendered residents.
